These general conditions of sale (hereinafter the “CGV”) apply to any reservation made by a natural person (hereinafter the “Customer”).

​

By using the Services, the Customer acknowledges having the full legal capacity allowing him to commit to these General Terms and Conditions and guarantees the veracity and accuracy of the information he provides.

​

ARTICLE 1: DEFINITION

​

The terms defined in this article, starting with capital letters, whether used in the singular or plural in the General Terms and Conditions, will have the following meaning:

​

“Customer(s)”: refers to natural persons, adults and capable, who make individual reservations for personal purposes on the Services of the Hotel La Bosselle

​

“CGV”: designates the document(s) emanating from the Establishment and describing the conditions and terms of stay in the Establishment, in particular arrival and departure times, child policies, etc. 

​

“Data”: refers to all information provided by the Customer during reservation operations, concerning him and the third party individuals for whom he is making a reservation, including personal data.

​

 “Establishment”: designates the Hotel La Bosselle establishment.

​

“Offer(s)”: designates the offer of accommodation in the establishment published on the Services including in particular the description of the Establishment, the presentation and particularities of each accommodation, the applicable rate, the guarantee and cancelation.

​

 “Services”: designates the Site of the Establishment on which Customers can make reservations in the Establishment.

​

“Site”: designates the website operated by Hotel La Bosselle on which Customers can make reservations at the Establishment.  

​

“Price”: designates the price and the applicable conditions (cancellation, modification, etc.) under these General Terms and Conditions and the Offer issued by the Establishment, retained and accepted by the Customer as part of their reservation and after confirmation of his reservation. This Price may include local taxes and/or supplements corresponding in particular to the additional services selected by the Customer.

 

ARTICLE 2: RESERVATIONS – GENERAL RULES

(i) Reservation Process;

​

- The online reservation made by the Customer is made on the Services.

- The reservation is deemed to have been made upon communication of a reservation number to the Customer on the confirmation screen; The Customer receives their reservation confirmation by email.

For each reservation, a reservation number is issued to the Customer. It allows the Customer to cancel their reservation when this is made possible by the special conditions applicable to the Rate reserved by the Customer.

- The Customer undertakes, prior to any reservation on the Services, to complete the mandatory information requested on the online reservation form.

- It is customary in the hotel industry that upon arrival, the rooms are made available to guests from 2:00 p.m. and vacated before 12:00 p.m. for departure. Any excess may result in the billing of an additional night at the public rate displayed.

 (ii) Price display 

​

For any reservation on a Service, the prices are valid at the time the Customer consults the Service.

​

Prices are displayed inclusive of all taxes by default in the currency attached to the language for consulting the Service selected by the Customer or defined by default by the browser via which the Customer consults the Service.

Any conversion into a currency different from that used by the Establishment is given for information purposes only and is not contractual.

All reservations, whatever their origins, are payable in the local currency of the Establishment, unless special arrangements are indicated on site by the Establishment. The Customer can contact the Establishment directly to obtain this information and find out its General Terms and Conditions.

If the debit at the Establishment is made in a currency other than that confirmed on the reservation, the exchange costs are the responsibility of the Customer.

In the event of a change in the conditions of the Offer during the reservation process on the Services (e.g.: price, availability, etc.), the Customer is informed before confirming their reservation.

Prices are dynamic and modifiable at any time without this being applicable to reservations already confirmed, unless legal or regulatory taxes imposed by the competent authorities change.

 (iii) Cancellation / Modification of the reservation by the Customer

​

  • For each reservation, a reservation number will be issued to the Customer, which will allow them, if necessary, to cancel their reservation, when this is made possible by the special conditions applicable to the Rate reserved by the Customer.

  • The conditions of the Reserved Rate specify the terms and conditions for canceling and/or modifying the Customer's reservation. When this is made possible by the Rate reserved by the Customer, any cancellation can be made to the Establishment. 

  • If you need to cancel a reservation, please inform the Establishment in time, respecting the cancellation deadlines  free cancellation if confirmed at least 48 hours before arrival / Non-refundable if cancellation is confirmed after 48 hours before arrival.​

  • Modification of the reservation can be made directly to the Establishment, whose telephone details are specified on the reservation confirmation sent by email.

  • In the event of interruption of the stay due to the Customer, the entire agreed price will be collected.

  • All reservations are personal and cannot under any circumstances be transferred to a third party, whether free of charge, for a fee or for commercial purposes.

 (iv) Reservation times on the Services

​

The sale of online accommodation on the Services stops for the same day between 8:00 p.m. and midnight (local time of the Establishment).

Late arrival is possible and the Establishment will then send an SMS to the telephone number registered during the reservation for any arrival after 7 p.m.

 

ARTICLE 3: PAYMENT TERMS

​

All reservations, regardless of their origin, are payable in the local currency of the Establishment, unless otherwise stipulated. The Customer is invited to contact the Establishment to find out its general terms and conditions and its specific payment rules.

If the debit at the Establishment is made in a currency other than that confirmed on the reservation, the exchange costs are the responsibility of the Customer.

Non-presentation (“No Show”): In the event that the Customer does not show up at the Establishment on the day of their reservation, the latter is considered canceled and the cancellation conditions of the reserved Rate apply. The Customer may be charged for the first night or the entire stay depending on the conditions of the reserved Rate.

Accepted means of payment (in addition to cash) are: Visa cards, Master Card. Other means of payment may be accepted, such as holiday vouchers.

We invite the Customer to contact the Establishment for the means of payment accepted.

ARTICLE 4: LIABILITY

​

Hotel La Bosselle and the Client undertake to carry out their commitments in accordance with the General Terms and Conditions in good faith and are responsible for any damage they may cause to the other party due to any fault attributable to them.

By making a reservation through the Services, the Customer enters into a direct contractual relationship with the Establishment. 

In all cases, the Establishment is solely responsible for the progress of the booked stay and more generally is solely responsible for the relationship with the Customer, particularly regarding the Offer and the reservation. The Customer contacts the Establishment to find out its General Terms and Conditions.

The photographs presented on the Services have an indicative value and are non-contractual. Even if every effort is made so that the photographs, graphic representations and texts reproduced to illustrate the Establishments presented give as accurate an overview as possible of the accommodation services offered, variations may occur, in particular due to changes in furniture or possible renovations.

Hotel La Bosselle cannot be held responsible for the non-execution or poor execution of the Client's reservation in the event of force majeure, due to the third party, unpredictable and insurmountable, due to the client, in particular the unavailability of the internet network. , impossibility of access to the Services, external intrusion or in the event of computer viruses.

The Customer acknowledges the risks associated with the use of the Internet. Hotel La Bosselle will make its best efforts to ensure with its suppliers the proper functioning of the Services but cannot guarantee that the Services are free from any anomaly or malfunction. Hotel La Bosselle cannot therefore be held responsible for damage resulting from the use or the total or partial impossibility of using the Services. In particular, its liability cannot be incurred in the event of non-performance or poor performance by the Customer, a third party or due to force majeure.

Any reservation or payment which is irregular, inoperative, incomplete or fraudulent for a reason attributable to the Customer will result in the cancellation of the order at the Customer's expense, without prejudice to any civil or criminal action against the latter.

As part of their reservation and stay, the Customer undertakes not to harm in any way the members of the Establishment's team as well as third parties present in the Establishment. Such behavior may lead the Establishment to expel the Client outside the Establishment without this Client being able to claim any right to compensation. 

In the event of damage, whether voluntary or not, by the customer, civil liability insurance will be incurred or the costs will be directly debited from the bank card for the reservation.

ARTICLE 5: MODIFICATION OF THE CGV

​

The applicable General Terms and Conditions are those accepted by the Customer at the time of booking.  However, Hotel La Bosselle reserves the right to modify these General Terms and Conditions at any time, without notifying the Customer. Such changes will take effect immediately. Any use of the Services subsequent to a modification of the General Terms and Conditions will imply acceptance by the Customer of said modifications. Consequently, the Customer is recommended to regularly consult these T&Cs in order to become aware of said modifications, to print and keep a copy of the T&Cs.

ARTICLE 6: INTELLECTUAL PROPERTY RIGHTS

​

These General Terms and Conditions do not involve any transfer of any intellectual property rights. The Customer has the sole right to browse and in particular to make reservations on the Services, throughout the world and under the conditions provided for in the General Terms and Conditions. The brands and logos appearing on the Site are the intellectual property of Hotel La Bosselle. Their use is prohibited without the prior written consent of Hotel La Bosselle. Partial or total reproduction in any medium whatsoever of this site or its elements is only authorized for personal purposes. The texts posted online on this Site, unless specifically mentioned, are the intellectual and legal property of its publisher Hotel La Bosselle. These original texts may be cited under the conditions laid down by article L.122-5 of the Intellectual Property Code, provided that the URL of the site is indicated in plain text or in the form of a hyperlink. Any photographic reproduction on the Site is the property of Hotel La Bosselle or has received prior authorization from its author. Any link from the Site has been subject to prior authorization, any link with the Site must be subject to prior written authorization.

ARTICLE 7: ENTIRETY AND TITLES

​

These General Terms and Conditions are supplemented by the legal notices, the personal data policy and the cookie use policy.

As these documents are likely to evolve over time, the most recent version takes precedence over previous versions. These contractual documents are applicable to the exclusion of any other document emanating from the Client which is not enforceable against Hotel La Bosselle.

These documents express the entire obligations of the parties with regard to the subject matter they cover. No general or specific conditions communicated by the Customer may be incorporated into these General Terms and Conditions.

In the event of a contradiction between the Booking confirmation and the General Terms and Conditions, the provisions appearing on the booking confirmation will be the only ones applicable to the obligation in question.

In the event of difficulty of interpretation between any of the titles appearing at the head of the clauses of these General Terms and Conditions, and any of the clauses, the titles will be set aside and the content of the clause concerned will prevail.

ARTICLE 8: FORCE MAJEURE

​

Force majeure means any external event that is unpredictable, insurmountable and external to the Client or Hotel La Bosselle. Force majeure or fortuitous events are those usually recognized by the case law of French courts and tribunals.

Each party cannot be held liable towards the other party in the event of non-performance of its obligations resulting from a force majeure event. It is expressly agreed that force majeure suspends, for the parties, the execution of their reciprocal obligations and that each party bears the burden of the resulting costs.

ARTICLE 9: COMPLAINTS – CUSTOMER SERVICE

​

Any request for information or complaint regarding a Reservation must be addressed to the Establishment.

The Customer is invited to transmit any complaint relating to a stay as soon as possible, in order to facilitate processing. He must also have taken care during his stay to report any inconvenience in order to limit any possible consequences.

ARTICLE 10: BLOCTEL

​

In accordance with article L.223-1 of the Consumer Code, a consumer who does not wish to be the subject of commercial prospecting by telephone can register free of charge on a list opposing telephone canvassing. This list is accessible via the following site: www.bloctel.gouv.fr.

ARTICLE 11: CONSUMPTION MEDIATOR

ARTICLE 12: APPLICABLE LAW 

​

These general conditions are subject to French law. In accordance with article L.141-5 of the Consumer Code, the consumer may, at his choice, seize, in addition to one of the territorially competent courts under the Code of Civil Procedure, the jurisdiction of the place where he resided at the time of the conclusion of the contract or the occurrence of harmful events. The Parties undertake to make their best efforts to reach an amicable settlement.
